Rules of the Game – Playing to Win-Win-Win

The Terms and Conditions documented below are provided to ensure that there is a clear understanding between you, as the client and Damien Digby, as your coach, as to what is expected during the course of our engagement and how we operate our business.

We have never needed any complicated contracts, formal agreements or complex get out clauses with our clients, some of whom Damien has worked with for well over 10 years – to be successful we must be collectively committed to results. We’re not in the business of wasting your money and our time or reputation.

Our coaching program is designed to work in the following sequence – a sequence that has been, tried, tested, proven and refined over 20 years to get maximum long term results for clients and what Damien lives by in his own Business and Personal life.

  1. Cashflow– The first stage of growing any business and the people within it is about making sure it delivers products or services that generate a ‘cash’ profit. It is impossible to create any sense of control or develop a vision that is beyond a pipe dream without a positive, growing bank balance. Nothing burns passion quicker than the opposite which is why we have to get this part right first before anything else. It is only with cash, not profit, that we can begin to develop the freedom from either time or financial constraints – both of which are required in abundance for genuine growth. Our goal here is to develop your business into a cashflow machine that reliably and consistently produces cash month in, month out.
  2. Buying Back Your Time – To create on-going positive cashflow growth and sustainable success you’re going to need time. Time to focus on your personal and business development which includes product or service improvement, efficiency, marketing and most importantly the development of your people. This is where we can begin to invest in the people and systems required to free up your time to concentrate on building a bigger, better, more reliable cashflow machine. One that can sustain your ideal lifestyle and produces enough cash for you to invest outside of your primary business.
  1. Wealth and Legacy – With your business producing more cash than it needs for you to live comfortably and meet all it’s obligations, while you simultaneously have the ability to truly manage your time, you’re now ready to focus on getting your money to work for you, so you don’t have to. To put it simply generating enough excess cash through your business to invest outside of your primary business – such as property or shares. It’s what the financial gurus call ‘diversification.’ The ultimate freedom and true definition of wealth is being able to live your ideal lifestyle whether you choose to go to work or you don’t. Risk Free

From the very beginning as we commence our working relationship we make your program risk free. At the completion of your Discovery Consultation if you feel we haven’t understood you or you are not confident that Damien can assist you in achieving your goals, you are free to walk away without any further obligation or any cost to you.

We simply refund your money and wish you the best of luck.

Your success relies on your genuine commitment.

Our expectation is that you will receive a benefit from being part of our program that far outweighs your monthly investment and that as long as that is the case we will continue to work together permanently. Many of our clients work with us for years and would not imagine running their businesses today without our support. Just like a sports team there is always the need for a coach if you want to win the game – ensuring continued improvement, accountability and success.

At any time should you wish to no longer be part of the program, for whatever reason, all we ask is for one full billing months’ notice in writing. Simple.

Your Program Investment

Payment is always on time and monthly in advance. Billing cycles are monthly on the same day each Calendar month. Payments are to be made by either an automatic direct debit from your nominated bank account or any major credit card through our secure processing partner Paysmart. We do not pass on any additional processing or credit card merchant fees.

Your Program Activities

The number and combination of the activities that we implement during your program will depend on their size, complexity and your ability to undertake the workload involved. The appropriateness, order and priority will be identified during the Discovery Consultation but may change as your business may require work in different areas than initially planned e.g. Team Recruitment during the course of the program. A Coaching Focus Sheet is completed during every Coaching Session and emailed to you after each session including any notes taken by Damien during the call. A 90 Day Plan is prepared every Calendar Quarter to map out your activities over the course of the program.

 

Your Commitment to the Program

Damien’s role is primarily that of your Coach.

To ensure that you achieve results and learn the lessons you will be required to do a minimum of five (5) hours per week on your business development activities as discussed and committed to during coaching sessions in addition to the sessions themselves. This work is designed to achieve the desired results within your business in the shortest possible timeframe.

Please note that initially these hours may be in addition to your current workload in the short term.

General Conditions:

 

  1. The materials you receive are confidential and proprietary, and cannot be used, disclosed or duplicated except within the ownership of your own company or entities. These materials are protected by copyright laws and no unauthorized copying, adaptation, distribution, storage or display, physically or online is permitted.
  2. While Damien will be providing you with guidance, direction and program materials, such a role is advisory only and not of actually implementing the activity itself. You will be primarily accountable for producing the results during the Coaching Program. In this way, we seek to educate, train and motivate you in order to make your ability to run a successful business a life-long activity. You bear sole responsibility for the use and implementation of these services in your business.
  3. Coaching Sessions are conducted over video conference (preferred method) or the Telephone. Using Video Conference (provided free) not only allows the provision of a visual of all participants but provides an easier platform to review reports together, share screens and edit working documents. A private environment free from any distractions along with a stable internet connection or clear phone reception is required to get the most from your coaching sessions.
  4. Coaching Sessions run for up to an hour in duration. You must be committed to being on-time and respect the time limitations of Damien’s schedule. Should you have a number of matters to discuss a bullet pointed email prior to commencement is advised. As other sessions normally follow all sessions will finish at the scheduled times. More time can be made available should it be necessary beyond scheduled session times.
  5. As a client you have unlimited contact with Damien outside of your coaching sessions over the phone or email during Business Hours. That means should you have an issue all you need to do is pick up the phone, send an SMS or email. You can also send any marketing material or any other documentation to Damien for review prior to implementation. Damien’s simple rule is “You are not allowed to stand still and you are not allowed to stay stuck.” We guarantee to make contact with you at the very latest by the close of business the following business day. Anything that requires a more urgent response must be marked as urgent which sends it to the top of the list.
  6. Scheduled Coaching Sessions can be re-scheduled, but often at the expense of desired times. If you need to reschedule meetings you agree to provide at least 24 hours notice or risk forfeiture of the session and any guarantee conditions. Damien will extend the same courtesy.
  7. Although unlikely Damien Digby Business Coaching may from time to time, alter the content or structure of the program as it considers necessary, but at all times will continue to provide value for money. You will receive written notification of any potential changes and have the opportunity to discuss them direct with Damien prior to implementation.
  8. You or your coach may elect to terminate the agreement at any time, for any reason, by giving a full one billing months’ notice in writing.
  9. If you are not satisfied with the services you have received, at any stage, we expect you to let us know so we can work with you to rectify your concerns. Should you remain unsatisfied we will refund your last month’s coaching fees – no further questions asked. Please note that if you change direction mid-month, fail to turn up to scheduled sessions, cancel appointments without proper notice or you don’t do your work through agreed commitments as per your Coaching Focus Sheet, including during a notice period, your fees will not be refundable.
  10. From time-to-time Damien will need to take a vacation, attend a workshop or conference, or require some time off due to illness or personal commitments. An allowance for this time is built into the program and fee structure to allow for 8 calendar weeks per year for personal leave. Generally 3 weeks are taken from the last week in December to mid-January and 2 weeks mid-year in July/August. You will receive written notification prior to any scheduled leave periods and all fees remain due and payable during these times. Should you require to take leave or miss any scheduled sessions outside of these specific periods Coaching Sessions can be used to coach or hold your team accountable in your absence, or be made up with either extended coaching sessions or extra sessions scheduled when required.  
  11. This agreement is the entire agreement between you and Damien Digby Business Coaching, all prior agreements, promises or representations being merged herein.
